NubiKids – Terms of Service

By accessing or using the NubiKids application (“App”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the App.

1. Introduction

NubiKids is a mobile educational application developed by Funcode SRL, registered in Cluj-Napoca, Romania (“Funcode”, “we”, “us”, “our”). These Terms govern your access to and use of the App and any related services.

2. Eligibility and Account Registration

  • Some features require sign-in using a Google Account or another supported method.
  • The App is designed for children’s learning, but account creation and sign-in must be performed by a parent or legal guardian.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

We may suspend or terminate accounts that violate these Terms or applicable law.

3. Acceptable Use

You agree to use the App only for lawful, educational, and non-commercial purposes. You will not:

  • Reverse-engineer, decompile, or attempt to extract source code or underlying ideas of the App.
  • Interfere with security, performance, or normal operation (e.g., via malware, scraping, or load testing).
  • Use the App to transmit content that is unlawful, harmful, or inappropriate for children.

We may update, modify, or discontinue the App (in whole or in part) at any time.

4. Intellectual Property

All content and materials in the App (text, images, graphics, sounds, UI elements, and educational content) are owned by Funcode SRL or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal educational purposes only. You may not reproduce, distribute, publicly display, or create derivative works without prior written consent.

5. User-Generated Content

If the App allows you to submit content (e.g., preferences, drawings, feedback), you represent that you own or have the rights to that content. You grant Funcode SRL a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for the purposes of operating, improving, and providing the App. Do not submit content that is offensive, unlawful, or inappropriate for children.

6. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which explains what personal data we collect (e.g., email for login), how we use it (authentication, security, analytics), and your rights. We do not sell or rent personal data.

7. In-App Purchases and Advertising

  • The App may include optional advertising and/or premium features available for purchase.
  • Purchases are processed via Google Play Billing; prices and availability may vary by region.
  • Ads, if present, are intended to comply with Google’s Families Policy Requirements. You can disable personalized ads in device settings.

8. Educational and Health Disclaimer

The App provides educational content for general learning purposes and is not a substitute for professional educational, medical, psychological, or legal advice. You are responsible for supervising children’s use of the App.

9. Warranties Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device or OS version.

10. Limitation of Liability

To the fullest extent permitted by law, Funcode SRL and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use or inability to use the App. Your sole remedy is to stop using the App.

11. Suspension and Termination

We may suspend or terminate access to the App immediately if you violate these Terms, misuse the service, or if required by law. Upon termination, your right to use the App ceases immediately. Certain provisions (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) survive termination.

12. Changes to the Terms

We may update these Terms from time to time. We will notify users by updating the “Last updated” date and, where appropriate, via an in-app notice. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Romania and applicable EU regulations. Any disputes will be subject to the exclusive jurisdiction of the courts of Cluj-Napoca, Romania.
