Terms of Service

Effective Date: June 5, 2026

These Terms of Service (“Terms”) govern your use of the NubiKids application (“the App”) developed and operated by Funcode SRL, a company registered in Romania (“we”, “us”, “our”). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using NubiKids, you confirm that you are a parent or legal guardian of the child who will use the App and that you agree to these Terms on your own behalf and on behalf of the child. If you do not agree, do not use the App.

2. Description of Service

NubiKids is an educational application designed for children. The App provides learning activities including vocabulary, reading, math exercises, and puzzles. Some features require a paid subscription (“NubiKids Premium”).

3. Accounts

  • You must sign in with a Google account to use the App.
  • You are responsible for maintaining the security of your account.
  • You must provide accurate information when creating child profiles.
  • You may create child profiles only for children for whom you are the parent or legal guardian.
  • Child profile pictures can only be selected from a fixed set of cartoon avatars bundled with the App; the App does not allow uploading photos from the device.

4. Subscriptions and Payments

4.1 NubiKids Premium

  • Some App features are available only with a NubiKids Premium subscription.
  • Subscriptions are billed monthly or yearly through Google Play, depending on the plan you choose.
  • New subscribers may be eligible for a 3-day free trial. You will not be charged during the trial period.

4.2 Billing

  • All payments are processed through Google Play Billing. We do not collect or store payment information.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through the Google Play Store.

4.3 Refunds

Refund requests are handled by Google Play in accordance with their refund policies. Contact Google Play support for refund inquiries.

5. Free Features

The App provides certain educational content at no cost. Free features may be limited in scope compared to NubiKids Premium and may change over time.

6. Parental Responsibility

  • The App is intended for use by children under parental supervision.
  • Parents are responsible for providing consent for data collection as described in our Privacy Policy.
  • Parents are responsible for monitoring their child’s use of the App.

7. Intellectual Property

  • All content in the App (including but not limited to text, images, sounds, animations, and code) is owned by Funcode SRL or its licensors.
  • You may not copy, modify, distribute, or create derivative works from any App content.
  • Voice content is generated using AI/TTS technology and is provided as-is for educational purposes.

8. Prohibited Uses

You agree not to:

  • Use the App for any purpose other than personal, non-commercial educational use.
  • Reverse engineer, decompile, or disassemble the App.
  • Attempt to gain unauthorized access to our systems or servers.
  • Use the App in any way that violates applicable laws or regulations.

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that educational outcomes will be achieved. The App is a supplementary educational tool and is not a substitute for formal education.

10. Limitation of Liability

To the maximum extent permitted by law, Funcode SRL shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the App.

11. Account Deletion

You may delete your account and all associated data at any time through the App’s Settings screen. Upon deletion, all personal data, child profiles, and learning progress will be permanently removed from our servers.

12. App Updates and Minimum Supported Version

We release periodic updates to the App to add features, fix issues, and maintain security. To keep the App secure and functional, we may from time to time require that you install the latest version. When this is the case, the App will display an update screen and continued use will be available only after the update is installed via the Google Play Store. We use this mechanism only when necessary (for example, to address a security issue or to retire an outdated version that can no longer connect to our services).

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of Romania and the European Union. Any disputes shall be resolved in the competent courts of Romania.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
